Mark A. Levine
Adjunct Associate Professor

Mark A. Levine specializes in land use, zoning, environmental law, historic preservation and real estate tax law. He heads Herrick's Land Use and Environmental Group, which advises clients in applications before state, city, town and village planning commissions and boards for zoning changes, special permits, environmental, historic and related matters; applications for special permits and variances before zoning appeal boards. Mark represents clients before the New York City Planning Commission, New York City Council, New York City Board of Standards and Appeals, New York City Landmark Preservation Commission, New York City Department of Housing Preservation and Development, New York City Department of Finance, New York City Department of Environmental Protection Agency, New York State Department of Parks, Recreation and Historic Preservation, New York State Department of Environmental Conservation and the U.S. Advisory Council on Historic Preservation as well as other historic preservation agencies.

As an experienced zoning and land use attorney, Mark has been involved in many large and complex transactions including land use and environmental approvals for the 900-unit Oceana residential development project in Brighton Beach, Brooklyn; the proposed 515-unit senior living project at the Seaview Hospital in Staten Island, NY; the rezoning of Greenpoint - Williamsburg, Brooklyn; a Variance for the Lenox, the first market-rate residential building to be built in Central Harlem in 60 years; the National Tennis Center, Flushing, New York; the million square foot office building and Brooklyn Mariott Hotel; Yale University with respect to the Divinity School and 85 Trumbull Street litigation; Brown University with respect to historic preservation issues; rezoning of Flushing, Queens, NY, the Regional U.S. Food and Drug Administration regional headquarters in Queens; the Harlem River Yard Transportation and Industrial Development Project; the Metrotech Project in Brooklyn and the New York State Psychiatric Building in Washington Heights.

Mark is a member of the Association of the Bar of the City of New York where he served as Chairman of the Committee on Housing and Urban Development.  He also acted as Chairman of the not-for-profit Fund for the Borough of Brooklyn for five years. Mark has been an adjunct professor at City University Graduate Center School of Urban Design and Architecture and Baruch College's Real Estate Program where he taught Real Estate and Planning Law. In addition, he has lectured at the Practicing Law Institute and numerous environmental and planning seminars.

Legal and administrative aspects of regulating land use at various levels of government, and understanding the changing legal framework of the regulations such as zoning, urban renewal and eminent domain, inverse condemnation, landmarks and religious considerations, environmental laws, growth management and the relationship of the planner to the law. The course will cover a basic understanding of legal procedures and use case law as well as statutory and regulatory materials to help you develop a better understanding of the relationship between the law and basic land-use planning skills.
